These Terms of Use ("Terms") govern your access to and use of the BRENKAV Games Club website at brenkav.com and your use of our physical facility located at 287 King Street West, Suite 200, Toronto, Ontario, Canada. By accessing our website or entering our premises, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website or visiting our club, you confirm that you are at least 13 years of age (or have parental consent if younger) and agree to comply with these Terms and all applicable Canadian laws and regulations. If you do not agree with any part of these Terms, please do not use our services.

2. Use of Our Website

2.1 Permitted Use

You may use the BRENKAV website for lawful, personal, non-commercial purposes related to learning about our services, contacting us, or accessing information about our events.

2.2 Prohibited Activities

You agree not to:

• Use the site in any way that violates applicable federal, provincial, or local laws
• Attempt to gain unauthorized access to any portion of the site or its systems
• Transmit any malicious code, spam, or unsolicited communications
• Scrape, copy, or reproduce content from the site without written permission
• Use the site to harass, threaten, or harm other individuals

3. In-Club Code of Conduct

All visitors to BRENKAV's physical location are expected to:

• Treat staff and other visitors with respect — harassment of any kind will result in immediate removal
• Handle all games equipment with care — damage to hardware may result in charges
• Refrain from bringing outside food or beverages into games zones (café purchases permitted)
• Maintain appropriate noise levels in Pro and VIP zones
• Comply with all BRENKAV staff instructions regarding club policies
• Not use games stations for illegal activities, including accessing prohibited content

4. Bookings and Reservations

VIP suite bookings are confirmed only upon receipt of full payment or deposit as specified by our staff. Cancellations made more than 24 hours before the booking start time are eligible for full refund or credit. Cancellations within 24 hours are non-refundable but may be rescheduled once at our discretion. BRENKAV reserves the right to reassign or cancel bookings due to technical emergencies, with appropriate alternative arrangements offered.

5. Tournament Participation

By registering for a BRENKAV tournament, you agree to:

• Abide by tournament rules as communicated at the time of registration
• Accept the decisions of tournament organizers as final
• Not engage in cheating, exploiting bugs, or unsportsmanlike conduct
• Grant BRENKAV the right to photograph or record tournament gameplay for promotional use

Entry fees are non-refundable. Prize distribution is contingent on verification of eligibility and compliance with all tournament rules.

6. Intellectual Property

All content on the BRENKAV website, including text, images, logos, and design elements, is the property of BRENKAV Games Club and protected under Canadian copyright law. You may not reproduce, distribute, or use our content without written permission.

7. Limitation of Liability

BRENKAV provides its website and services "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, BRENKAV shall not be liable for any indirect, incidental, or consequential damages arising from your use of our website or facility, including loss of data, equipment damage (unless caused by our negligence), or loss of games sessions due to technical issues.

8. Indemnification

You agree to indemnify and hold BRENKAV, its directors, employees, and agents harmless from any claims, liabilities, or expenses arising from your violation of these Terms or misuse of our services.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes shall be resolved in the courts of Ontario.

10. Changes to Terms

BRENKAV reserves the right to update these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our website or services after changes constitutes acceptance.
